Agreement to Terms

By accessing or using Orbitri's website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Services

Orbitri provides web design, development, and related digital services. Our services include:

• Custom website design and development
• E-commerce website creation
• Website redesign and optimization
• Conversion rate optimization
• Ongoing maintenance and support (as agreed)

Project Process

Our standard project process includes:

1. Discovery: We discuss your needs, goals, and requirements
2. Proposal: We provide a detailed scope, timeline, and pricing
3. Agreement: Upon acceptance, a deposit is required to begin work
4. Design & Development: We create your website with milestone reviews
5. Launch: Final approval and site deployment

Payment Terms

Payment terms are outlined in individual project proposals. Standard terms include:

• 50% deposit required to begin work
• Remaining balance due upon project completion, before launch
• For larger projects, milestone payments may be arranged
• Late payments may incur interest at 1.5% per month

Intellectual Property

Your Content: You retain ownership of all content, images, and materials you provide to us.

Our Work: Upon full payment, you receive full ownership of the custom design and code created specifically for your project.

Third-Party Assets: Some projects may include licensed fonts, images, or plugins. Licenses for these remain with their respective owners.

Portfolio Rights: We reserve the right to display completed work in our portfolio unless otherwise agreed in writing.

Revisions and Changes

Each project includes a specified number of revision rounds as outlined in your proposal. Additional revisions or scope changes may incur additional fees.

Major scope changes after project commencement will require a change order with updated pricing and timeline.

Warranties and Disclaimers

We warrant that our work will be performed in a professional manner consistent with industry standards.

We do not guarantee specific results such as search engine rankings, conversion rates, or revenue increases, as these depend on many factors outside our control.

Our services are provided "as is" without warranties of any kind, express or implied, except as specifically stated in your project agreement.

Limitation of Liability

To the maximum extent permitted by law, Orbitri shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.

Client Responsibilities

You agree to:

• Provide timely feedback and approvals
• Supply necessary content, images, and materials
• Ensure you have rights to use provided materials
• Make payments according to agreed terms
• Designate a single point of contact for project communication

Cancellation

Either party may terminate a project with written notice. In case of cancellation:

• Client pays for all work completed to date
• Deposits are non-refundable
• Work-in-progress may be provided at our discretion

Confidentiality

We agree to keep confidential any proprietary information shared during our engagement. This does not apply to information that is publicly available or independently developed.

Governing Law

These terms shall be governed by the laws of the State of New York, USA, without regard to conflict of law principles.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date.
